It really depends. 

You have to reach a really high level of deliberate tax evasion for it to rise to the level of it being criminal rather than just being assessed a penalty and interest.

The tax Code has such a number of gray areas and it is a fine line between being very aggressive in terms of deductions and other ways to lower your liability and complete criminal evasion. 

There is always going to be an argument that you merely interpreted the Code in a certain manner and the IRS interpreted it in a different manner.

I could be wrong but in general the people charged with criminal tax evasion like Richard Hatch (Survivors) and The Situation (Jersey Shore) failed to report large sums of money as income so there wasn't a question of interpreting the Code and taking a deduction - they literally just didn't report income. 

I would think that Tom and Ericka would be able to claim that they were merely *agressive* in their interpretation of permissible deductions.

I have had experience (unfortunately) with a few sociopaths who are lie as naturally as breathing. 

My observation is that they are able to get away with it for a variety of reasons - they surround themselves with paid employees/sycophants who have no interest in refuting the lies;

many people don't really listen to people carefully so any inconsistencies aren't noticed; 

people don't generally bother to correct people who are lying unless it impacts them so they get used to being able to lie and assume they are getting away with it.

I was involved in a lawsuit with a sociopath who was a consummate liar like Erika. It was quite something when he was deposed under oath because it was one of the few times that he was being forced to answer questions - and more importantly follow up questions - by someone who was determined to get him on record as lying. Sometimes he would claim he didn't recall - he also claimed that he was unable to read when presented with documents he had signed. And sometimes he was unable to restrain himself because he would become so angry at the person who was forcing him to answer questions and then he would trip himself up and start contradicting himself. That is what depositions are intended to do when the attorney is a skilled questioner

This was obviously a ridiculous staged attempt to look *humble*.

For starters evidently she was shopping in Pasadena - no reason anyone would go from West Hollywood to Pasadena to shop at Marshalls. It's really a long haul especially because of the weird connection you have to make in order to get on the 134 East from Hollywood/West Hollywood as there is no direct connection so you have to get off the freeway and then drive to get to the nearest on-ramp going east. There is only a direct connection if you are going west on the 134.

And apropos of turning over five times because of snowy conditions, it is preposterous and why would the son be rushing to the hospital of his mother's estranged husband - neither of them would have medical powers of attorney so they wouldn't even be given patient information.

There is a TJ Maxx a few blocks from Beverly Hills across from the Beverly Center which is close to her current residence and one in Santa Monica also in an upscale location.

I don’t think anyone needs to drive 1.5 hours each way to go to one in Pasadena.

If you need cheap crap, there are far better sources in Los Angeles for legitimate sales.

Well she apparently ran up over 100K on the Amex in the month before she left and according to Rinna she refuses to say how she afforded her move, her rent, her car, etc.  which either means she has a new source of financial support (man) which makes the most sense or she started stockpiling money for the day she left. 

Now I'm wondering if maybe Tom was starting to show signs of dementia a few years ago and she decided to start stockpiling her own nest egg for the day everything came crashing down.  She never mentioned Tom's condition because it allowed her to continue her outrageous spending and hide funds for the day she left.   I remember the scene where she was showing Tom all the things on the grounds that needed $attention$ and wondered why wouldn't she just take care of it?  Maybe because she was saving for the day she left? 

I don't know but it sounds like she knew about some of the allegations years ago so...

She has some expensive legal representation - Wowza. 

Graduated Yale Law School and a partner at one of the heavy duty firms in the LA area.

He is probably billing at more than $500 per hour - that would be a low estimate and I would suspect closer to $750 per billable hour if not more. 

She must have some secret stash or someone is funding her because her *legitimate* income - i.e. BRAVO salary and social media income doesn't support that kind of expenditure.

I was involved in a relatively simple lawsuit almost 20 years ago which settled after a relatively small number of depositions and had minimal pre-trial motions and my legal bill was close to $150,000.

I remember the episode where they all had dinner together and I remember thinking Bethanny had figured out that the whole Erika Jayne persona was laughable, although she was reasonably polite (for Bethenny) about it. Since I have always felt it both laughable and pathetic, I was pleased to see someone was not buying the BS. Of course, when I thought it was laughable, I had no idea there were actually victims involved. Nothing funny about it now, but it remains pathetic.

Tiago should be able to turn around comfortably in the crate. Maybe when he was a pup this was fine, but he’s obviously outgrown it. I’m thinking as well that he may have a back or joint issue, which is why she bought the ladder for the SUV. But he needs a larger crate. How can she be so oblivious to this? (Don’t answer.) My only hope is he’s not in it for very long, and that when Her Highness is going to be away for a day or longer, someone checks in on him or he’s boarded.

I don’t think he is in that thing. If he’s having joint/back issues, he’s definitely not.  It made me wince to see him. We had a Dachshund with a disk problem that required surgery, and it was a long, painful slog with her. I think shepherds like Tiago are also prone to severe back issues, mainly due to breeding.

I'll have to go back and look at the crate that she has Tiago in and see if it is on the small side.  Most dogs don't prefer big crates because they like it to be tight like a den.  I have owned many dogs over my lifetime and trained when I was in college and I have always crate trained from Dachshunds to Dobermans to Mastiffs.  Dogs sleep a lot and aren't usually too active as adults in crates or just hanging out in the house. Tiago is a Dutch Shepherd and I would guess that they suffer hip dysplasia like a lot of Shepherd breeds.  I saw a video of Erica talking about him and he seems well taken care of even though I have despised this woman since day one, she seems to care for him.
