And you're SO right - it IS just like he's just with a bunch of roommates ! RU may have the zoning laws and occupancy restrictions down pat but there's nothing about Jesus Jail that even remotely resembles a real rehab. The lack of degrees, accreditations, professional staff, oversight, or accountability speaks for itself - Josh is at sleepaway camp for naughty, naughty people who are getting a six-month long timeout. 

Sleep away camp is such a perfect description for RU. A bunch of boys hanging out, talking about their bestie, Jesus, staying up late in their shared bedroom, being watched by former campers. I bet they're drinking "bug juice"; the extra sugar really helps the heroin addicts.

Because IG sucks and doesn't have the actual date,I had to go and do math and use a calandar. The picture was uploaded 125 weeks ago, which puts it approximately around August 17, 2013.

Which is not at all in the time frame of Danica Dillon's allegations.

He said he was passing through, and I think that's the truth. Shortly after that he posted a picture of the Ohio boarder.

I'm pretty sure that dates back to the infamous motorhome roadtrip. 

 

eta: IANAL, but isn't the ous on the defendant to prove an alibi? I'm sure Danica's team will have something to counter anything that LAWYR tries, but it's on him to do it. 

 

And to whomever asked, I looked up the guy from the legal papers, and we found that he's a biker-lovin' dude whose bike's vanity plate reads LAWYR. I can't even remember his real name without going back to look it up. LOL

I don't get why some lawyers have a stupid vanity plate like that.  I'm a lawyer and I would be ashamed to "brag" about my horrible decision of becoming a lawyer to the public like that.

The onus of proof would fall on the plaintiff no matter what, in this case Danica. Her team would have to prove that Josh was there. The defendant doesn't have to even have a defense. It sure as hell helps though! But since she is the one claiming it happened, it would be on her to prove it. 

 

It would be like if I said that you dented my car, and I took you to court for damages. It would be up to me to prove that you are the one who dented my car. You wouldn't have to prove anything, but if you had definitive proof that you were not guilty then you could use that to help prove my case wrong.

Ain't gonna happen.  It's their way or no way!   Children are not individuals but extensions of themselves.  That's exactly right, he was pushed into a marriage so he could "meet his needs" legally, and he still did what he was doing.

I hope this all doesn't circle back to Anna not meeting his needs.  What she needs to do is leave his ass, but she won't.  Her brother is right and the Duggars are wrong.  As someone said up thread they would do well to pay Danica off and make this all go away.  But then again I thought none of them should have ever been on t.v. again.  They must have a real need to be in the spotlight, good or bad.

If Josh really didn't fuck Ms Dillon, it's worth fighting, settling with her will encourage more people to make claims. I assumed he did pay her for sex, and she was really just trying to cash in, but now it seems one of them is making their whole story up, and I don't know who to believe.

 

Hmm, who to believe?  The woman or the child molester and serial cheater who lied to his wife?  Hmm?

He's got to face real world consequences in a real world courtroom. Oh the horror!

I hope he gets tried by a lesbian judge and gets manhandled by a butch bailiff named Ute.

Even if that scenario plays out, I'm sure it's still more dignified and less embarrassing than Gothard or Boob public tribunal/shaming.

Maybe he'll be sentenced to undergo actual court ordered therapy with a REAL licensed therapist! Perhaps this might be the best thing that could have happened as there might be a chance now that he'd actually get the help he needs.

Lily and Ellie are the biggest Duggar sycophants out there. Of course they don't want a divorce. These fools want the show restored to its former glory for crissakes! I am only surprised that they didn't blame Anna for her husband's failings. I bet most fundie women, behind Anna's back, DO blame her, as they would blame themselves in a similar situation.

Yeah, I still had the window open, now curious, and saw that it was from that loon (perfect word choice, btw). I stopped right there. She and her husband Ken are cuckoo for Cocoa Puffs. Ken has participated in flame wars on FJ that were epic. Delusional doesn't even begin to describe them.

That's not Josh's idea; it's his lawyer's citing the legal doctrine of estoppel.  There are situations in which under normal circumstances a person would be able to assert a right, but something else they've done negates the claim.  This is a civil case and the rules are different, but I'll give you a real-world example from a criminal trial.  I live in a state that has a Stand Your Ground law.  There was an incident a couple of years ago where a man stabbed a woman to death.  There was no question that he did it as a result of being threatened by her, but he was convicted of manslaughter anyway because the stabbing occurred during a drug deal gone bad.  The Stand Your Ground law states that a person has no duty to retreat IF two conditions are met:  1. the person has a legal right to be where they are, and 2. they are engaged in lawful conduct at the time.  The defendant did not meet the "engaged in lawful conduct" test; therefore, even though the deceased was trying to rob him and had a weapon, the defendant had a duty to retreat.  If the exact same scenario had played out during a Craigslist transaction, he most likely wouldn't have been charged, much less convicted.  So, yes, in court it sometimes does turn out to be relevant that the person bringing the suit was engaged in illegal activity at the time of the alleged incurred damages.

 

That LAWYR is probably pulling his hair out by the handfuls and throwing every excuse/"defense" against the wall to see if it'll stick.

 

IANAL, but I am related to several and I know someone personally who has been through a civil sexual assault case from the plaintiff side.  The motion from Josh's attorney looks pretty run-of-the-mill to me.  It's going through each of the claims in the plaintiff's filing and giving an affirmative defense to as many of them as possible.  It's not dirty tricks; it's just what you do.  I also don't have any suspicions about the timing.  We don't know what kind of advice Josh was getting from his lawyer re: how much he was allowed to say about the case in public.  We don't know how much access Josh has had to his lawyer considering he's been in a facility that won't even let your family members come visit (that was probably the most interesting part of the filing to me--the acknowledgement that Josh has actually been staying at RU).

 

Furthermore, the memo Josh's lawyer attached to the end reminds me of strategies I've seen play out in divorce battles where one side continually ignores deadlines to produce court-ordered documentation in order to frustrate the other side.  It makes me suspicious that she was more interested in the publicity than justice; otherwise you'd think she'd have her ducks in a row on the most basic documentation.  Josh's attorney is claiming that he has submitted "more than one hundred pages of alibi documents to Plaintiff’s counsel, as well as video footage and photographs. Defendant also supplied the contact information of many eyewitnesses to ensure that substantive initial disclosures were produced..." but that Danica has yet to produce the documentation of her claimed damages.

Or it could be neither of those things.  There's also the possibility that Josh is still gross, but he has an alibi AND that she thinks she's being truthful.  What if she had an encounter or two with some random pudgy 20-something in an orange mask who told her he was the famous Josh and she believed it because she was feeling ready4this in DC?  (please note I don't think this is actually what went down.  It's just what happened to be behind Door Number Three)

Perhaps the documentation produced in pictures and video was of Danica engaging in the activity she described as occurring with Josh, but they are pictures and videos of her performing the same or similar activity with co-actors in the course of her adult film career. Now maybe the defendant's lawyer is saying that the descriptions are so similar that she may have mixed up her contact with Josh, or may be getting treated not for the incidents with Josh alone, but with all the other guys which have now added up to PTSD.

Just a thought ...

 

I can scroll and ignore, but I find myself feeling a little uncomfortable when the Josh jokes include the molestations. No matter what Jill & Jessa say about it, 5 young girls were assaulted and that is not funny.

 

No offense intended to anyone, it never feels as if anyone is intending to make anybody feel uncomfortable.

She asks a good question. She can also go to her nearest convenience store, buy a bag of dicks, and eat them for basically letting the Duggars off the hook in her interview. Not a single pressing question, and few to no follow ups. Their story was transparent BS. Shame on her for being a PR person instead of a journalist.

Unless I'm mistaken ... or things have changed in the last couple of days and I wasn't paying attention ... it's still just a civil trial, right?  So there would be no sentencing.

That would be so great if the judge ordered real therapy for ole Joshy!  I have a nephew whose wife begged him to get a job (she got preggers by him and believed his lying ass that he spent his days job hunting).  After 2 years she was done begging and filed for divorce.  He asked for alimony and the judge gave him 6 months to get a job.  The judge did what the family couldn't - convince him that work was a good thing.

I'm not an attorney but I'm pretty sure you are correct. He can't be sentenced in a civil trial, just ordered by the court. She could offer to drop the suit if he agrees to counseling or the judge could order it.

I should have posted to say court ordered. My bad. I guess I will show myself out to the prayer closet...I should know the way by now...
