Josh now seems to be feeling quite bold and shames Danica Dillon for indulging in 'illegal activities.'

 

Well, the paper describes it as "shaming," but it's not that; it's a statement in a legal filing and it's relevant to a possible affirmative defense.

 

I didn't do it, but if I did, it doesn't count because whore. Nice, Josh.

Pleading in the alternative. You want to make sure all your possible defenses are on record, in case the court's finding on the facts doesn't go your way. It's not out of the ordinary at all.

This whole he wasn't in PA thing is a mystery. I would think that it would be easy to prove his whereabouts on the nights in question. A smart phone is like a tracking device.

If he wasn't in PA, why didn't he announce it as soon as Danica Dillon made her accusation? If he was in PA, what good would it do him to lie? He will just be found out later. It really is a mystery.

I agree, it makes no sense. If someone accused me of murder, I wouldn't wait until my sentencing to speak up and say "hey, you know what, I just remembered I was at the movies when the crime took place." I wonder what sort of angle Josh and his attorney are playing.

I'm not sure of the timeline of all these things. Was Josh at rehab when Danica went public? Could he possibly just be getting all the actual details of this? As other folks have mentioned it wouldn't be hard to prove where Josh was. Between cell phones, random security cameras, road tolls, plane tickets, hotel keys, etc.

Perhaps he didn't want to fuel the tabloid fire. Ms Dillon's claims came out after the Ashley Madison stuff was revealed, I think he was already off being brain washed at RU, his life and career were already destroyed, few would've believed him anyway. If he's bluffing this will eclipse his previous idiotic choices.

I mean I know that we know that Joshie-poo is completely under his father's control, but the law does not care about those things and Josh and only Josh would have been served with the suit, whether he was in adult Jesus camp or not.  He knew,

But when was he actually served?

 

 

Edited to add: Rehabs and mental health facilities do not have to confirm who are using there services- even to the police. He would have to sign a release to be served at RU.

Between scandal #1, the Megan Kelly interview, scandal #2, Jill's shady missioncation trips and "going away" party, Derick's surgery, Spurge's birth debaucle and the civil suit, my brain is fried.

Just for clarification, Josh is not at rehab or a mental health facility.  From a legal perspective, Josh is just living in a new house with a bunch of roommates.  

 

And I do not believe for one second that Josh would not get an immediate tongue thrashing from Boob whenever another scandal emerges.

Thank you for clarifying, LilyoftheValley  ! I couldn't quite put my thoughts together cohesively enough to say what you said so succinctly...

 

And you're SO right - it IS just like he's just with a bunch of roommates ! RU may have the zoning laws and occupancy restrictions down pat but there's nothing about Jesus Jail that even remotely resembles a real rehab. The lack of degrees, accreditations, professional staff, oversight, or accountability speaks for itself - Josh is at sleepaway camp for naughty, naughty people who are getting a six-month long timeout. 

 

I wonder if JB thought that stowing him away would shield him from any real-world consequences ? Seems like he was thinking just like the people in horror movies who try to hide in a church assuming that the vampires can't get to them there. But we all know how that works out...

Because he is handling this assbackwards - just like everything else in Duggarland.  I have had to give up trying to understand Duggar logic as it only serves to give me a headache. 

Their first attempt was to handle it themselves -- after all, Jim Boob probably prayed a lot before he watched an episode of CSI: SVU, and now he's practically an expert on the lawyering!

 

When it became clear that "handling it themselves" wasn't going to work, they lawyered up. (Excuse me: LAWYRd up.) That LAWYR is probably pulling his hair out by the handfuls and throwing every excuse/"defense" against the wall to see if it'll stick.

Because IG sucks and doesn't have the actual date,I had to go and do math and use a calandar. The picture was uploaded 125 weeks ago, which puts it approximately around August 17, 2013.

Which is not at all in the time frame of Danica Dillon's allegations.

He said he was passing through, and I think that's the truth. Shortly after that he posted a picture of the Ohio boarder.

And to whomever asked, I looked up the guy from the legal papers, and we found that he's a biker-lovin' dude whose bike's vanity plate reads LAWYR. I can't even remember his real name without going back to look it up. LOL

I don't get why some lawyers have a stupid vanity plate like that.  I'm a lawyer and I would be ashamed to "brag" about my horrible decision of becoming a lawyer to the public like that.

The onus of proof would fall on the plaintiff no matter what, in this case Danica. Her team would have to prove that Josh was there. The defendant doesn't have to even have a defense. It sure as hell helps though! But since she is the one claiming it happened, it would be on her to prove it. 

 

It would be like if I said that you dented my car, and I took you to court for damages. It would be up to me to prove that you are the one who dented my car. You wouldn't have to prove anything, but if you had definitive proof that you were not guilty then you could use that to help prove my case wrong.
