zoeysmom October 1, 2014 Share October 1, 2014 (edited) Thanks. I love Amy Phillips, but I think that was the wrong link! (Don't worry about it - we're close enough to the date that we can do our own math now). My prediction stands - prison time for both of them. Those quotes were from Joe and Teresa's lawyers spinning the charges for sympathy, and from defense attys who didn't appear to read the indictments or plea agreements. Jennifersdc October 1, 2014 Share October 1, 2014 Who's Amy Phillips? I did try to post something last night asking Rhetorica to start the countdown clock and add staggered sentencing to my pool. Apparently I hit a wrong button, so my carefully written, grammatically correct reply never made it (see Jim Marchese). I'm going back to 9 months for Teresa. The Star-Ledger is the one paper that generally has it right on this topic. Didn't know about the "tied" plea (the not a lawyer thing). Still think Teresa will do jail time on the BK fraud. 1 Link to comment

phoenix780 October 1, 2014 Share October 1, 2014 (edited) Amy Phillips is on Bravo's payroll? Good for her- I didn't realize that. I'm only slightly curious to see what the verdicts are. I'm more interested to find out what happens after. Which network will her reality show be on? Will Gia sign on, or opt out (she doesn't seem thrilled to be on camera all the time)? How loud will Milania have gotten? Or, will Teresa aim for something like Dancing with the Stars where she can ease her way back into famewhoredom? All this after a series of Us Weekly covers about her inner strength, of course. So many possibilities... Edited October 1, 2014 by phoenix780 4 Link to comment

I am going to say this --there is an old trick amongst criminal defense attorneys-when predicting sentencing of other criminal defense attorney's clients you predict the mitigating term or low ball it. If the defendant gets it you are a genius or you sound very knowledgeable. If the defendant gets more time then it sounds like the defendant's attorney didn't do as good a job as you would have done. I vacillate and since we can't read the pre-sentence report I am thinking she will get a suspended sentence and probation. I say probation and then the next poll on here will be how long before Teresa's first probation violation. Edited October 1, 2014 by zoeysmom Link to comment

More reason not to trust their predictions. As for your prediction (!), however, I don't understand why people still think Teresa will escape time. Even if Joe tries to say it was all his idea, this is where Teresa's so-called stardom works against her. That article is saying that Joe plead guilty to help Teresa, but I just figure the Guidices plead guilty because they are guilty and 2) the lawyers didn't want to take the case to trial because the lawyers want to get paid and they know the Guidices have no money and would lose the case against the feds anyway. Actually pleading guilty early in the proceedings is a good thing under the federal sentencing guidelines. Joe is taking the burden of the responsibility so that is why the Teresa camp is holding out for probation. I am at a loss to explain how Joe masterminded Teresa's lying under oath about her book deal and payments from magazines. Television news-I am thinking Nancy Grace HLN-she likes these breaking stories of reality TV stars is where the most coverage will come in. Alex McCord will weigh in a RH and if Teresa is incarcerated she will have Wendy Feldman, Teresa's incarceration specialist on. Link to comment

Lablover27 October 1, 2014 Share October 1, 2014 I wonder if In Touch was at the party this past week end. Zoey, your posts make me so nervous. On the other hand, I am prepared because of them. If it is probation for Tre, I may call our IRS guy to tell him I'm going on a hunger strike! Call the press! Um, ya, that will never happen. I love cheese too much. I know how hard it is when I'm gone for one night for a 15 year old!!! Like I said, even 3 months would be awful but well deserved. I know some people don't understand my fierce need for Tre and Joe to do time. I'll remind everyone about our IRS installment payments we have to make. It sucks, especially around the holidays. You can't put kids through college. They have to take loans. You can't take vacations, they are just waiting to take your home. But Mr. Lablover does it. It's embarrassing in some ways. You have to do without and keep your home AND your equity away from liens and penalties. That's why I get so pissed off they went without filing tax returns, following the law we all have to. {Small business owner - no crooks here} Fortunately, we can finally see the blue sky. But we - I mean Mr. Lab - freaking did it. I haven't bought something new for myself in three years. I've lost weight and my shorts fell off in the grocery store the other day. I have the same shoulder over little purse for the last 6 years. I have to buy school clothes. So, yes, I'm a little pissed off. I don't see either of them trying to make any sort of payments. Then they get caught. And still show no remorse. Finally, they put their property up for sale. I don't see Juicy trying to work hard to keep his property. I saw a lot of trophies in his huge home office. Don't they always look so wonderfully dressed going to court. There, I said my peace once again. Tap, tap, tap, fingers on the desk, it will be interesting. 7 Link to comment

Have faith! I am hoping that the Judge is also a Mom and sees the reality that Teresa/Joe put their greed BEFORE the welfare of their daughters and throws the book at them, giving them both the max IN prison according to the plea deal. I don't care if 1 does time before the other but would prefer to see them do prison at the same time. I hope she sees that they made NO effort to repay any of the people they scammed before they filed their fraudulently BK or after they withdrew it and then promised to repay. I hope the Judge factors into her decision that Teresa/Joe kept living well beyond their means even after they were caught AND after they ADMITTED to their GUILT! Teresa - 18 months behind bars Joe - 36 months behind bars I also hope the Judge makes them pay the max amount allowed by law in fines and court costs. Then, I hope that everyone the Giudice's scammed line up at the closest magistrate's office, or court, and files lawsuits against them to collect what they are owed. TheFinalRose October 1, 2014 Share October 1, 2014 I do not understand how Teresa's guilt is somehow less than Joe's guilt. She is as guilty, I think even more guilty, than Joe because she had more income coming in at the end WHEN THEY WERE ALREADY IN TROUBLE AND INTERACTING WITH THE COURTS and still hid it. I always thought that Joe is not smart enough to think this up himself, that either his buds or someone he knew showed him how to work the system, told him that everyone does it, and if you get in a pickle you declare bankruptcy and start over. Which a lot of people did in the past ten years. Obviously it worked for the Guidices for a long time, and I hardly think Joe was the one who had to have the excess we see in the marble mausoleum. Tre designed those finishes that cost so much and I don't think she understood, or still understands, the nature of a financial crime. In her mind jail is for rapists and murderers and she is neither of those. I bet she always told herself "We ain't hurtin nobody" everytime she signed off on another fraudulent loan application and as long as they were paying something back they were golden. Hence her constant proclamations that she doesn't understand why this is happening to her family and her four beautiful daughters. She is so dumb that I think the only way she figures it out is when another inmate sits her down in the television room at the pen and draws her a picture of her and Joe taking out money, and then a line going to all the tradesmen they used, and then a line of payment going to Nordstrom's instead of the tradesmen's families, and then a picture of the tradesmen's families in unclensy houses with sad faces compared to a pic of Tre's house and kids with happy faces. Something like that might get to her, but eh, I don't know. She is certainly one for the books. In fact if I was in Congress I'd be sponsoring the Teresa Guidice Financial Education Bill which requires all high schools graduates to pass a financial literacy exam before being let loose into the world. 8 Link to comment

zoeysmom October 1, 2014 Share October 1, 2014 Here is my take on Teresa and her getting probation-nothing will change in her life other than Juicy will be out of the picture by the holidays-barring some reason for him not to go in 45 days such as he decided to take the state case to trial and the Feds BOC (Bureau of Corrections) won't want him until he is done. (The BOC would have to pay to transport him and the cost of a marshal to sit with him.) Probation Teresa, will promise Bravo the moon and the stars and they will give her another $800,000.00 or so (of which she will have pony up 25% post taxes to the feds). Of course knowing Teresa she will say she has no guarantees of a contract and the court will say she has to pay $400.00 a month or 25% of anything she makes over $14,000.00, a month. Teresa will live large in her over-priced house citing no buyers and when filming resumes in January Bravo will get nothing from Teresa in the post sentencing or visiting Joe in prison with the girls. Needing to justify Teresa's salary as a last ditch effort, Victoria Gotti much like Kim D. will find another person to dump on a new housewife or one of the twins. We will see a repeat of this season only maybe Teresa will be in the middle of it. Probation Teresa will take zero accountability for Victoria Gotti and blame the twins for them being upset. Bottom line is very little will change for probation Teresa and the only change would be if Bravo put its corporate foot down and said, "thanks for the table flip, see you around Teresa." 1 Link to comment

Hopefully the probation officer who is doing the sentencing report as well as the judge are aware of the Giudices' true attitude about their crimes. 4 Link to comment
One Tough Cookie October 1, 2014 Share October 1, 2014 (edited) The best way for Teresa to stay out of prison - take an IQ test. They could argue she's not mentally competent. Of course, she'll need someone to handle all of her affairs from now on, but wouldn't that be for the best? That is, as long as that someone is Joe. OMG--I just laughed so hard my eye make u is running down my face!!!! eta: my prediction {hope}: Tersea--6-9 months Juicey--36 months Edited October 1, 2014 by One More Time 2 Link to comment
jinjer October 1, 2014 Share October 1, 2014 Teresa's crime is less than Joe's - she didn't plead to the IRS stuff IIRC. Her fraud was in lying about working those years on mortgage application forms. She didn't work, so she didn't have to file. He did work, he did have to file, so he is the one that pled guilty to one count of failing to file. So her sentence automatically will be less than his because she plead guilty to one less count. 1 Link to comment
