Erika Girardi/Erika Jayne: Let them eat cake

Those $750,000 diamond earrings that Erika fought bitterly to hang onto but were snapped up by Ronald Reynolds' wife at the bankruptcy trustee's auction for $250,000 are still being fought over!

The appellate court heard Erika's appeal & ordered the matter back to the bankruptcy court for presentation of evidence on whether money used to pay for the earrings was pilfered from Tom's client trust account.  The appellate court decided there was an insufficient showing in the court below of the source of the funds used by Tom to purchase the earrings.

It's not a win (yet) for Erika. Though she may be crowing about it, the earrings are not back in her greedy hands.  Depends on the proof now to be shown in the bankruptcy court.  If adequate proof is shown, the earrings will remain with Reynolds. If not. . .

Ball is in the trustee's court.

So she claims she lost weight because she went thru menopause and not because of Ozempic and when someone pointed out to her that women typically gain weight after menopause she changed it to “I went to the doctor and I said get it off.”  Girl...

At least Erika didn't lie about getting the diamond earrings back now that the appellate court has granted her appeal.  The appellate court sent the matter back to the bankruptcy court for a specific determination about whether Tom paid for the earrings with money taken out of pilfered client money. (Appears he did. If so, she won't get them back.)

She also mentioned that she recently reached out to & met with some of the Tom's victims.  If so, seems her lawyers -  finally - got her under control - forcing her to think about the optics - and to stop boasting or over-stating events.

She seemed more truthful about recent contacts with Tom as well - stating that some of his days are better than others.  Waxes & wanes, as dementia does. (More in line with the expert, a specialist in malingerers, who has deemed Tom competent to stand trial.)

But weight loss from menopause??? Said no woman ever!  Not with that gaunt Ozempic face & body. LIAR!

Hmm, while I get that women typically gain weight during menopause, Erika didn't say the weight loss was a natural side effect of menopause, but that she went to the doctor and addressed her hormones and said "get it off." Maybe she meant she was fuller figured for awhile going through menopause? I do think she is someone who was pretty slim her whole life. She said when she was young, she was "a stick with an ass." Her breasts are only large due to implants. I believe she does have the body that is more naturally slim and not big or super curvy. She was in phenomenal shape well into her 40s and only got curvier a few years ago.

I am no expert on menopause, but what make me suspicious is how damn bony she is now. Her legs are heading into Sutton territory, and that concerns me. (I think Sutton is healthy, just has naturally tiny legs.) I don't know if the results are from Ozempic or something else, but I agree with you all that her face and body look suspiciously skinny. I can believe her losing a lot of weight at her age though. I haven't been through menopause myself, but I've seen it happen. I thought she looked fabulous even with the few extra pounds though. She had that Marilyn Monroe type of body, which isn't as in these days, but very pretty and feminine.

Why is everyone so quick to shut down the Ozempic talk?  If it works, go for it - no one cares how you do it if it's healthy or medically prescribed.  My sister started it not too long ago, and I'm very happy for her.  Hope it works out.

There’s some jealousy with the Ozempic accusations (myself included) since most can’t afford and insurance usually won’t cover it. So, it’s yet another rich person advantage and then they Lie about it which really steams everyone.

Absolutely - I get it.  My sister is lucky because her insurance will cover it.  But I don't understand why celebs lie about it.  It's obvious that's what they are doing, so why don't they (Rinna speak) own it?

Part of the problem with Olympic being used just for weight loss if it had created a shortage for the diabetics that really need it.  I have a diabetic friend having a hard time getting her prescription filled because all the pharmacies are out

Well, my going thru the change was 7 years of hot, sweaty hell and I did not emerge skinny- (or a crook, but I digress) I also ended up with curly, straw-like hair that is impossible to control.

I have yet to meet a woman who lost weight going thru the change. Of course, I’ve also never met a woman who refused to turn over a pair of earrings worth over $500,000, when those funds were supposed to go to victims…

Absolutely! I was always tiny between menopause, the pandemic and major back surgery I gained 40 pounds. It took me a year of exercising religiously (Pilates, aerobics and yoga) to drop 7 pounds. I'd like to know what kind of menopause  Erika is going through!

They say after 50 a woman can chose her ass or her face after 50. I chose my face. Erika seems to have chosen her ass.

Once again Erika reveals how stupid she is. Women GAIN weight after menopause, dumbass.

Also, I'm reading health news stories that say some of these drugs seriously affect gastro systems in older patients.

Because there are people like my friend that had a heart attack and open heart surgery and really needs Ozempic but has a hard time getting it. It is prescribed to her as she needs to lose weight for real medical issues, she has excellent  health insurance, but the manufacturers are out of it so often, she has not been able to be on it consistently. Doctors are supposed to prescribe for health issues, not spoiled Reality stars that want to be even thinner. But, money talks .

It’s something called stomach paralysis. You cannot digest food. Two pharma companies — Lilly is one, forget the other — are being sued over it.

Tom Girardi's competency hearing with respect to the Los Angeles federal court criminal indictment against him takes place tomorrow, August 23, 2023. (The concurrently pending Illinois federal court criminal case has received the reports filed in the Los Angeles case and will likely defer to the LA court's ruling.) The prosecution expert determined that Girardi is only mildly cognitively impaired and faking more serious dementia. The defense experts determined that Girardi has mid-stage dementia.

If found incompetent by the Judge, the Judge can order Girardi to federal prison (for a period of up to 4 months) for an evaluation to determine whether Girardi is able to participate in his defense. (That is, understand the charges against him, confer with his counsel, relate facts that bear on his defense.)  If found competent, a trial date will be set.

The first day of the competency hearing for Tom Girardi took place today in federal court in Los Angeles with respect to the criminal indictment against Girardi.

The government's expert witness, a neuropsychologist, testified today. She concluded that Girardi has mild cognitive impairment & is malingering.  The expert's arrived at her conclusions after extensive interviews with Girardi, after which, she determined that Girardi was able to follow questions & conversations, even though he questioned why he was there being interviewed.  The expert testified that she viewed the Hulu program, "The Housewife & the Hustler," & the American Greed program for general background, as well as a videotape of the complex litigation panel that he headed just shortly before the bankruptcy filed, his assets frozen, & his claim of dementia first arose.

The expert stated that while Girardi was "self-protective" about discussing details of the case against him, he was able to discuss with her, at length, various hypotheticals she posed to him that mirrored his case. While he claimed not to remember one of his wives, he took a call from her during a break & asked her how her trip to Spain went.

Defense counsel argue that Girardi is unable to learn & retain information and therefore, unable to assist in his defense. (And should be declared incompetent.) Girardi's scores on a variety of tests went from high, dipped to low, then scored high again, suggesting a waxing & waning of his condition.

Girardi arrived at the courthouse, far from his dapper self, but practically dressed like a clown - but for flapping clown shoes.  Instead, he had on gray slippers instead of shoes, with an oversized plaid gray jacket, a blue checked shirt & voluminous khaki pants.

He doesn’t look that bad. He lost a lot of weight, so his clothes are huge, and clownish.

https://pagesix.com/2023/08/23/tom-girardi-arrives-at-court-for-mental-competency-hearing/amp/

He didn't lose that much weight - it's just that the clothes are too large for him (he's a small guy) & don't match. It took thought to pull together an outfit that mismatched.  Plaids with checks. Gray with blue with khaki.  Slippers, not shoes.  Even if he or his caregivers don't give thought to what he looks like on typical days, given the importance of this hearing, his conservator brother could have well ensured that Girardi was well-dressed (or at least matching & shod) for this hearing. So it would seem Girardi's mismatched, slipper shuffling "look" was a conscious decision.

Many assisted living homes offer weekly barber and hairdressing services to the residents, including the dementia floor residents - but clearly, he didn't avail himself of it.  All to look more disheveled. Lost. Poor. Unable to care for himself.  Not fooling many & won't fool the judge.

Girardi is facing a Hobson's choice - really no choice at all.  Either he's deemed competent & goes to trial on the criminal indictment, probably convicted & if so, to prison. Or he's ordered to federal prison for up to 4 months for a mental health evaluation to determine whether he's competent to stand trial, or conversely, that he's incompetent (cannot understand the charges, penalties & cannot assist in his defense) & to be held in the mental hospital portion of the federal prison system for some determinate or indeterminate time, or in rare instances, to some type of monitored release.

I watched a news story on Dateline last night, his apparel looked totally staged imho and I also doubted his demeanour, it just looked like he didn't quite have that vacant lost look of a person with dementia, but he was trying hard.  And who cares if he's competent or not - he deserves to be in jail, he can live the rest of his life there.

oops not Dateline = NIGHTLINE (sorry I do that a lot lol!)🙃

Sounds like he is trying to pull a Vincent Gigante.  Little bit different circumstances and story but none the less, similar:

For about 30 years, Gigante feigned insanity in an effort to throw law enforcement off his trail. Dubbed "The Oddfather" and "The Enigma in the Bathrobe" by the media, Gigante often wandered the streets of Greenwich Village in his bathrobe and slippers, mumbling incoherently to himself.

Erika sued again!  This time in connection with a criminal indictment Erika & Tom Girardi cooked up against a costumer, Christopher Psaila, who she claimed overcharged her or racked up unauthorized charges of nearly a million dollars through Psaila's business, Marco Marco.

Through Tom's "connections" to a Secret Service agent Rob Strange, she & Tom got Strange (who may have owed Tom a quid pro quo because Tom helped settle a lawsuit for Strange) to investigate & ultimately convince the local U.S. Attorney's office to bring a 9-count federal criminal indictment against Psaila.  (I believe I described this in a Feb. 2023 post either in this thread or the media thread.) Meanwhile, Tom also got American Express to refund the $787,000+ back to him, though Amex's investigation later found a billing discrepancy of only $4,500.

After 4.5 years & just before trial, the indictment was dropped by the US Attorney's office for lack of evidence. In the interim, Psaila, who had been trying to adopt a child with his partner, was denied that opportunity given the criminal indictment pending against him. Further, before the charges could be dropped, Psaila's father died of cancer & his brother died of drowning, never knowing he'd been cleared. As such, Psaila alleges reputational damages, loss of business, expended defense fees, & emotional distress.

The Psaila lawsuit, filed in federal court in Los Angeles, alleges malicious prosecution, violation of constitutional rights & conspiracy against Erika, Erika's assistants Michael Mindin & Laila Ribatallada, American Express, Rob Strange (the Secret Service agent) and two other agents, all of whom are defendants in this lawsuit.

While as to other lawsuits, Erika claimed she lacked knowledge of Tom's actions (withholding settlement money to various clients) - her fingerprints are all over this.  It's her costumes, her claims of overcharges or unauthorized charges that later proved to be untrue, & she's purportedly the one who met with Strange to urge criminal prosecution of Psaila.  She even wore a wire to a meeting with Psaila about the charges. Even though Tom likely steered her to agent Strange & Tom likely the one who squeezed the refund back from AmEx, Tom's not a named defendant, however, probably because his competency issues would just gum things up.

Erika may be dealing with her Las Vegas residency, but she's also going to be enmeshed in this new litigation that seeks over $18 million in general damages, other damages, and an unnamed sum in punitive damages.

And Hulu has just released Part 2 of the Housewife and the Hustler about her and Tom.  This one rakes her pretty good.

For instance, she meets with two of her husband's victims and literally says "remind me - what happened to you again?"  Geez, you narcissic bitch - the least you could have done was researched them.  She even says she watched Part 1 - the woman's son was burned in an explosion you stupid c**t.

Obviously Erika hasn't handled the ordeal in an intelligent manner, but she must be playing dumb there. We all know she does listen and has a good memory. Whatever the reasoning, it is bananas that comes out of her mouth when she's trying to redeem herself. No, Erika, no.

I really hope these victims get help. They've been through enough while Erika lived like royalty.

Right, she was all memory and engaging with Sutton's "erudite" friends in Spain, drunk off her ass.

But she can't seem to remember a thing that happened to Tom's victims.

She said the reason she hadn't reached out before was because she wasn't asked.  Oh I'm sorry Erika, you need to be asked to show compassion for people who went through horrific things due to your husband's negligence?

She can't blame editing anymore. Done with her after watching how she acted with those women (& what she did to that designer.) She strutted in Like the queen doing a royal briefing. They were much classier toward her than I would've been, and even more than she deserved. I'd actually let Annemarie stay if they'd drop Ericka from the show. let her get a Real job and no more attention.
