S02.E07: State v. Queen

Oliver is concerned when a mysterious illness sweeps the city, infecting hundreds of people, including Diggle. Oliver discovers Vertigo in Diggle's blood and realizes The Count has broken out of prison and is once again distributing his drug, only now to unsuspecting citizens of Starling City. It's Vertigo withdrawal that's making everyone sick. Meanwhile, Moira goes on trial for her participation in the Undertaking. ADA Adam Donner collapses in court with Vertigo withdrawal symptoms and is kidnapped by the Count to send a message to Starling City, that another dose of Vertigo will cure their symptoms. Due to his absence, and the fact that he publicly endorsed taking Vertigo (under severe duress), Laurel must step in and try the case against Moira. Oliver is torn between standing by his family during the trial and catching The Count. However, things change when Felicity follows a lead and walks straight into a trap set by The Count.

I do really like this episode for the Olicity. I also thought that Seth Gabel had finally found just the right mix of menacing and comic book villain. (And I liked the way he said Oliver.) A nice character moment for Felicity where she was willing to sacrifice her life so Oliver didn't have to break his no kill policy.

Why can't my suspension of disbelief for this show extend to Laurel being  counsel on Moria's case?

 

It's the little things for me. Oliver and Moira's kinda smile at each other after she enters the courtroom.

 

I hate courtroom stuff unless its Ghostbusters.

I LOVE this episode. It's in my top 5 of the season.  I just love the twists and turns. I loved Vertigo in this episode. All the Olicity. All of it. And my Queen - Moira. The trial is stupid but I don't care because everything else.  MALCOLM

Sometimes this show just makes me swoon.  I tell ya. Those two crazy kids and their pretty faces just kill me.  I honestly wasn't planning on watching the rerun tonight, but happened to have the tv on while I was working on the computer and just didn't leave.  Couldn't bring myself to shut it off until after "He had you...".

 

The courtroom stuff is so hilariously bad it's actually kind of embarrassing for all involved, both in front of and behind the scenes. 

 

And random fun fact that is perhaps more appropriate for the You Know You're Watching Too Much Arrow thread - the actress who played Carly in S1 was in a Hallmark movie a while back where she was a bridesmaid and her dress was a knockoff of Felicity's pink peplum dress (without the cut out in the back).

"Before you said that, you said 'Gah' and *thud*..."--Felicity  She is such a mama hen to the guys. Love her!

 

This time I caught the date of when Thea visited Moira, October 9th; the same date as the season premiere. If this has already been spoken about, I apologize.

 

Thea's boxing scene really was one of the best scenes. Roy and Thea also had one of their most honest moments with that scene. (Despite Roy still being eyes and ears for Ollie, he wasn't going out and mixing it up with street thugs. White lie, but closer to the truth than Moira's "coming clean" scene with Oliver and Thea.)

 

Laurel v Moira? Moira, by a mile, even defeated by the ADA's trump card. Moira v effing Malcolm? Tie; her terror, know that he can now destroy what's left of her family, up against his righteous (self-righteous?) anger at being lied to about a child he fathered.  I felt badly for Malcolm, but then remembered how he treated/ didn't treat Tommy and wasn't too sorry for him. 

"Have you tried heroin?"--another Felicity line; loved her covering afterward about not trying it. Hey, Dig? You live in a comic book tv show and you work for a vigilante who uses arrows and is trying not to murder folks. Almost insta-addictive ain't that hard to believe.

"You're really on the 'No Killing' wagon, are you? Pity." --The Count

 

Laurel's life is just a bubble of Ego, isn't it? She actually does okay to well cross-examining Moira and putting her in a bad spot. After the recess or whatever, this grown-ass woman sees Oliver, freezes, then turns and almost literally runs away from him.  Then she's all " How can you forgive me?" ::rme:: Laurel, gumdrop, the concept of forgiveness is not about you, unless you are forgiving someone. Oliver's forgiveness (not that you should need or want it for simply doing the job you couldn't wriggle out of taking on) is not dependent on you. Forgiveness is for the person forgiving, which is why I wasn't surprised you couldn't deal with Sara. You're a black-mailing, grudge-holding, score-keeping bitch; of course you can't understand why someone could find a way to forgive you.  (Sorry, I'm not in a place where I can forgive Laurel or the writers yet.) That Oliver was actually there to check on you should not have been a surprise. Yet, it was. ::chorus of 'I know you in my bones' floats through my head:: *sigh*

 

Yet, there was great Team Arrow friendship, Felicity's cool nail polish (white or very light blue), and plenty of bon mots before the Count did a bad, bad thing.

Usually I make myself dismiss it because of the ridiculous trial but I don't care.  The rest of it is awesome and only gets better on rewatch.

I've taken to randomly yelling "OBJECTION, YOUR HONOR!" during all courtroom scenes when I rewatch this episode. I sometimes even add the reasons, like "OBJECTION! HEARSAY!" or "OBJECTION! COUNSEL IS TESTIFYING!" Makes the scenes go much better. And all I know about trials I learned from The Good Wife. *g*

This episode was one of the most gratifying and also one of the most infuriating episodes of the season for me.  The gratifying moments are, of course, the Team Arrow and Olicity moments, as well as the Queen family moments and Thea/Roy scene.

 

Then... there's the speediest murder trial in modern American history, being prosecuted by a junior ADA with a conflict of interest and personal ties to the defendant's family.  

 

This episode also provides another example of the inconsistency and hypocrisy of Laurel's character.  A lawyer takes an oath upon being licensed to practice law and has a sworn obligation to comply with the code of professional conduct (legal ethical standards governing the profession).  Laurel is shown to be a good lawyer by fulfilling this legal obligation and vigorously prosecuting the case against Moira to the best of her ability, despite her personal feelings for the Queen family.  Yet, in the same episode, Laurel is shown to be a bad lawyer by violating this legal obligation by going to see Moira in prison without Moira's lawyer's knowledge or presence and moreover, by disclosing prosecution strategy.  So which is it?  Is Laurel a lawyer who puts legal ethics above personal loyalties, or is Laurel a lawyer who puts personal loyalties above legal ethics?  You can't have it both ways.

 

Then, while struggling to reconcile this inconsistency, I realized that it's actually not inconsistent at all but in character for Laurel.  In public, she wants to present this facade of being a good, ethical lawyer who will zealously do her job regardless of personal cost.  But in private, in secret, she is willing to break the rules for personal reasons.  Even though she knows she risks disbarment, she doesn't really believe she'll get caught.  And, incredibly enough, even though prisons keep a record of visitors, no one ever finds out that she visited Moira on her own, so she is never threatened with disbarment or any disciplinary action.  (I also surmise that she didn't want to alienate Moira completely because, on some level, she hasn't let go her fantasy of becoming a part of the Queen family.)

 

So the apparent inconsistency is actually hypocrisy.  If Laurel ever became D.A., I suspect that while she will publicly appear and claim to enforce the laws and prosecute cases aggressively and fairly, in secret she will bend the rules for family and friends.

Ten thousand points of light, this episode is. (Quiet please, I'm ignoring the legal shenanigans.)

 

Seth Gabel, Olicity, Team Arrow, Roy helping his girlfriend deal with her anger issues the only way he knows how... there's just a lot to love here, and it just keeps getting better on rewatch. I could watch the whole scene with the Count at QC on repeat (and let's not pretend I haven't), but there are two moments that just stick with me -- and both are focused on Oliver's face.

 

First, when Oliver gets the call from the Count, and he's listening to him say he's got Felicity -- Oliver's clearly tense, but he's still waiting to figure out exactly what the Count knows/wants. But the moment that sentence ends with "Arrow", Oliver's face explodes into angry determination. His expression in that moment reminds a lot of Season 1 when Felicity intentionally got caught counting cards in the casino; Oliver's listening patiently to the conversation Felicity is having, but the moment the casino owner crushes her earpiece, it's game over for him. It's just a "Felicity's in danger? This ends NOW" kind of thing. (Sorry, I'm a fan.)

 

Then, when Oliver actually shoots the Count: the first time around I was totally pulled in by how instinctual it was -- he literally did not think about it (he didn't have time to). But on rewatch, I really caught on to his face after the Count when out the window. It was like his brain had been trying to form the sentence "you're going to kill him," but his reflexes were so fast that he didn't get the message until after the Count had fallen. It was like he blinked and suddenly came back to himself and what he'd just done. I think that's what sold that for me as "there was no choice to make" -- from [my overanalyzing of] Oliver's expression, he literally did not make a grim decision to kill the Count to save Felicity. His body instinctively recognized and dealt with the threat while his mind was still trying to process the consequences.

 

This may be all on me obsessively staring at Oliver's facial expressions (what? don't judge), but I'm gonna give SA all the credit for the nuances he provides for weirdos like me to pick up on. Fantastic stuff.

Ugh I just want to marinate in this perfect piece of meta. I've rewatched this scene more times than I care to admit (I think I'm coming up on 750?) and this is the perfect description of everything I too saw in that moment where Oliver put not one, not two but three arrows into the Count for merely threatening to shoot Felicity up with a drug he knew he already had an anecdote for. And he would've put more arrows into him too if The Count hadn't ya know; fell out the window.

"Quiet please, I'm threatening."  I think he may be my favourite of the short-arc villains.  I didn't like him in s1 but Seth Gabel nailed it here, only to die.  I wouldn't have minded him being brought back to life again.

 

I know this episode is called "State vs Queen" but I always think of it as "Oliver saves Felicity from the Count."    It didn't help that anyone taking even a non-legal ethics course found so many things wrong with Laurel's behaviour  

 

I love Thea's black dress and the side silver bracelet (Willa Holland did good portraying nervous waiting for the jury).  Felicity, on the other hand, did a couple of bad DiD moves, keeping her QC badge (she's not wearing it at the cave earlier, was it in her coat pocket?) and those ridiculous shoes to go hunting the bad guys, and I'm embarrassed for her.

 

Does Oliver keep a green leather suit in the trunk of his car?  Who mends the leather when it gets torn when he gets shot as he did here?

 

"You poisoned me and put me in a home.  How I hated you for that.  Turns out someone else hates you too... Who?  Oh, you're going to be so surprised when you find out. Turns out he's a man of means. Set me up so I could draw you out."  

 

I love how worried Oliver looks when he lowers the bow and throws away his arrow as the Count threatens Felicity.

 

When Diggle is feeling ill, Oliver offers to call Lyla for him (nice set-up) but Diggle is all "she'll only worry" manpain.

 

Felicity says "I'm really starting to wonder what it would take to impress you guys", 

setting up Felicity's insecurity about her worth to the team since she can't go out and fight like Oliver, Sara and Diggle do.

 

I wonder how many times that window at QC needs to be replaced.  I'm counting 3 so far.

The person who will be most saddened at the Queen's loss of their company is the glass shop that replaces their windows. I mean, almost every other week or so, someone shoots the place up, so they must be delighted that business is goooood! Then again, since the Arrow is still around, there are other folks with glass needs, too. I am sure that having Glazier to the Queens is a nice feather in the cap of the owner though.  (Yes, I occasionally think about the nigh-forgotten glass-makers who aren't in it for High Art. Especially in cops and super-hero shows.)

I'd think something along the lines of Felicity claiming that she forgot she needed to something something for "Mr. Queen" and decided to come in and get it done before start of business the next day. Then Count shenanigans ensued. I'm not married to that, but she probably told a better cover than Oliver could attempt. *g*

SA doesn't get nearly enough credit, in my opinion, for little things like that.  He says so much with his facial expressions.  I'm consistently blown away by what he's able to do with the material (unapologetic Stephen Amell fangirl here).

Then it seemed to return when he got back to the courthouse and had a moment for it to marinate a little more. I kind of think it was about him breaking his code and his vow to honor Tommy by not killing again. Then I see the scene at the end of the episode where he tells Felicity "there was no choice to make" (which btw is one of my favorite Olicity scenes) and I kind of backtrack on the courthouse scene and wonder if Oliver was so upset because not only he'd just killed again, but because he almost lost Felicity and what the thought of that reveals to him regarding his feelings for her. I don't think he was in love at that moment, but there was something much deeper than friendship blooming and perhaps some part of him was starting to realize this when he almost lost her.

I didn't have a problem with Laurel warning Moira. Though illegal, it's a trope that's been used many times on TV when it comes to lawyers and their friends who are in trouble. Where she lost me though, was when her plea for Moira not to testify turned into her going on and on about how SHE didn't want to be the one to destroy the Queen family and how SHE didn't want to have to live with doing this to Moira and her children. That really didn't do Laurel any favors at all because it came off looking like she didn't want Moira to testify because she didn't want to deal with the guilt her cross-examination would cause and that her plea ultimately had nothing to do with sparing the Queen family any heartache.

 

Hilarious Moment:

 

Ivo telling one of his minions "You survived your own stupidity, congratulations." LOL

 

Nitpicks:

 

How was Slade even walking around with half of his face burned off? He should've been completely incapacitated.

 

Blood arranged for the Count to take out The Arrow, we learn early on he's not the sharpest tool in the drawer. Did he really think the Count, a drug dealer (not a gangster) could take out someone as deadly as the Arrow?

 

Why wasn't Thea and Oliver there to escort Moira home from jail after she was acquitted?

 

This was another one of my favorites from S2.

That - along with his apology to Felicity in 2x10 and his ramble about Barry dreaming about Felicity in coma - are two of my most favourite Olicity scenes.

I think since the premiere of season 2 (when Oliver told her that he was happy to see her in Lian Yu and then again mentioned that a friend - Felicity - told him that there was another way) the writers were laying foundations of a romantic arc for Oliver and Felicity which came to the fore in 2x06 and kinda got confirmed in 2x07 with "there was no choice to make" line. Oliver may or may not have realized (he was jealous of Barry for next three episodes after this) it in 2x07, but I do believe he was genuinely falling for Felicity.

I was hoping that Oliver would rebuke or ignore Laurel after she tried to crucify his mother, but "Are you all right?"  Argh!  That, IMO, was a misstep.

I wonder if Oliver felt guilty for "abandoning" Laurel at that point.  The previous year he was all about her and now he's so busy with his mother, Thea, QC, Arrowing and his team of Diggle and Felicity, he doesn't have time for her at all.

Felicity: "He needs more than that. When Dig passed out, I sent a sample of his blood to a chemist I know at QC. The guy owes me a favor. Long story, I fixed his parking ticket. Huh. I guess it's not that long."
Oliver: "Felicity. The blood sample."
Felicity: "Yeah. It came back positive - for trace amounts of Vertigo."
Diggle: "I never used Vertigo before in my life." 
Felicity: "You were exposed to it somehow."

Felicity: "When the Count recovered from his OD on Vertigo, he was sent to Iron Heights."
Oliver: "That got hit in the quake. He got out the same way the Dollmaker did?" 
Felicity: "And just like with the Dollmaker, prison officials worked overtime to keep the lid on the escape. I know what you're thinking."
Oliver: "No, you don't. I made a choice not to put an arrow in this guy. And it was the right choice. There's no more killing. I worked this up to counteract the effects of Vertigo. Give it to Diggle. I - I need to get back to court. While I'm gone, just work up whatever you can and figure out how Diggle got Vertigo in his system without his knowledge."
Felicity (nods): "Go."

The Count (on PC screen): "You see - a simple solution. I'm Count Vertigo, and I approve this high."

Oliver (to Diggle): "At least let me call Lyla."
Diggle: "All she could do is worry about me."
Felicity: "I found something."
Oliver: "I don't see anything." 
Felicity: "Because you have to see what Donner does." 
Oliver: "His eye caught a reflection. Can you enhance?"
Felicity: "It hurts me that you feel a need to ask." 
Diggle: "What are those? Wings?"
Felicity: "It's the city seal. Starling Municipal Records Department. That building's been abandoned since the city went to digital. Dollars to donuts, that's where is operating out of."
Oliver: "Not for long."

207 (State v. Queen) - Laurel makes an unethical visit to Moira in prison:
Moira: "You shouldn't be here. My attorney needs to -"
Laurel: "Moira. I know I could be disbarred for speaking with you, but this isn't something for lawyers. This is a family matter. Jean told me she's calling you to the stand tomorrow."
Moira: "Yes."
Laurel: "You can't testify."
Moira: "Well. The fact that you don't want me to, Laurel, is a good indication that I should."
Laurel: "If you take the stand, I'll have to cross examine you, and I'll have to do it to the best of my ability."
Moira: "Yes, I understand."
Laurel: "No, I don't think you do. (Shows her a document) Forget about what this will do to Oliver and Thea. It also could undermine your entire case. So, Moira, please. Please. Don't make me use this. Everything is at stake for you. And I don't want to be the one to take it all away."

207 (State v. Queen) - After Laurel cross-examines Moira on the stand about her affair with Malcolm Merlyn, she once again thinks only of herself:
Oliver: "Hey."
Laurel: "Okay, if you want to attack me, go right ahead. But you should know that you're not going to say anything that I haven't already said to myself."
Oliver: "Whoa. I know that that was difficult for you, and I just want to make sure that you're okay."
Laurel: "No, no. I don't understand how you can forgive me after what I just did in there. I don't understand how anyone could."

207 (State v. Queen) – Felicity and Diggle figure out that he got exposed to Vertigo through a flu shot injection, and Felicity volunteers to go check out the flu truck:
Diggle: "Oliver's going to be pretty wrapped up with his mother. You making any process on how The Count's getting Vertigo into people's systems?"
Felicity: "Not much. Each dot is the home of somebody with withdrawal symptoms." 
Diggle: "That seems pretty random." 
Felicity: "That's because it's very random." 
Diggle: "Okay. What if people weren't exposed at home? What if they got dosed at work? Can you do this by their employment addresses?"
Felicity: "I'm really starting to wonder what it would take to impress you guys... It's like - it's a trail. A path through the city.  Any place you've been?"
Diggle: "59th and Dale. That's where I got my flu shot."
Felicity: "You got your vaccination from one of those trucks, right? One of those roving flu trucks? The route. It's a flu vaccination tour.  A truck sent out by Starling City Mobile Care."
Diggle: "I got addicted after one injection? That can happen?" 
Felicity: "Sure. Try heroin some time. Not try, try."
Diggle: "All right, where's the truck now?"
Felicity: "Downtown. What do you think? Call Oliver?"
Diggle: "No, no, he's busy with his family. I'll go." 
Felicity: "Yeah, no. That's not happening. I'll go."
Diggle: "Felicity, it's too dangerous."
Felicity: "It could turn out to be nothing. If it's not, I'll call."

207 (State v. Queen) – Oliver rescues Felicity from the Count:
Oliver (on phone): "Felicity."
The Count (on phone): "Oliver. Is it okay if I call you 'Oliver'? Surprised to hear from me, right? Not as surprised as I was. You see, I find this not unattractive blonde, getting all up in my business. And what does she have on her? A Queen Consolidated I.D. badge. (Oliver closes his eyes briefly) Now, I think to myself, why does that name ring a bell? Oliver Queen. He tried to buy off me last year, just before the Hood put me in a padded cell. Ipso facto, Arrow." 
Thea: "Where are you going?!"
Oliver: "Uh - something's come up at the office."
Thea: "Ollie! The jury!"
Oliver: "I have to go."
*  *  *
The Count: "Pretty swanky offices. You can see all the destruction that your mom caused from up here." 
Oliver: "What do you want?" 
The Count: "World peace and personal satisfaction. Though not necessarily in that order. You poisoned me and put me in a hole. You have no idea how much I hated you for that. Turns out, someone else hates you, too."
Oliver: "Who?" 
The Count: "Who? Oh, you're going to be surprised when you find out. He's a man of means. Set me up with my new operation so I could draw you out."
Oliver: "To do what?" 
The Count: "This." (Shoots at Oliver)
Oliver: "You're going to have to try harder."
The Count: "Done! (Pulls Felicity up) Come on! (Drags over to the windows by her ponytail) Ahh! So now we move on to plan B." (Holds needle by Felicity's neck)
Felicity: "Oliver, don't! Not for me!"
The Count: "Quiet, please. I'm threatening. (To Oliver) Lower your bow."
Oliver: "Your problem is with me. It's not with her."
The Count: "Well, then, consider this your penalty for making me go to plan B in the first place." 
(As the Count prepares to inject Felicity, Oliver shoots three arrows into him, and the Count crashes out the window and down to the ground below. Oliver closes his eyes briefly and then comes over to check on Felicity.)
Oliver: "Hey. Hey. Shh, shh. It's all right. You're safe."
Felicity: "Oh, you were shot."
Oliver (cupping her cheek with his hand): "Hey. It's nothing."

207 (State v. Queen) – Felicity apologizes to Oliver for forcing him to break his “no-kill” rule in order to save her:
Felicity: “Congratulations. Is that appropriate?”
Oliver: “She should have lost. She should have been convicted.”
Diggle: “Did you want her to be?”
Oliver: “I expected her to be. Verdict doesn't make sense.” 
Felicity: “Still, your mom must be thrilled. Beyond.” 
Oliver: “It's more like shock, I think. They're processing her now. I just wanted to check in on you (looking at Diggle). And you (looking at Felicity).
Diggle: “I'm feeling better.”
Felicity: “And, with the Vertigo tainted vaccine, Queen Consolidated's Applied Sciences Division was able to formulate a non-addictive treatment.”
Oliver: “Good. I need to meet my family at home. So you guys go home, get rest. Good night.”
Felicity: “Good night… Oliver? I, uh, I just wanted to say thank you.”
Oliver: “Yeah.” 
Felicity: “And I'm sorry.”
Oliver: “For what?”
Felicity: “I got myself into trouble again, and you killed him. You killed again, and I am sorry that I was the one to put you in a position where you had to make that kind of choice.”
Oliver: “Felicity. (Puts his hand over her hand) He had you, and he was going to hurt you. There was no choice to make.”

I love this episode. It had a lot of goodness in it including the Count and his craziness and a good way of getting the Vertigo around the city in the flu vaccine. "Quiet Please, I'm Threatening!" Seth Gabel was so good. Oliver breaking his no kill rule for Felicity, Oliver saying there was no choice to make. Oliver pointing out that his mother most definitely should have been convicted and the Malcolm shenanigans therein - oh when I was still interested in Malcolm craziness, a long time ago. 

Oliver grabbing Sara in the FBs and Celina Jade's amazing look of disgust when she realises Oliver was having an affair with his picture's sister. She ever really had much of a POV after that but Oliver was definitely dumped. 

Sigh, I know they addressed it a little but Laurel should never have been anywhere near that case. Both sides would have wanted her nowhere near The DA's office because she might feel loyalty to the Queens and do what she did, The defence because of Oliver's treatment of her and the Sara issue. It just bugs me. But I know they have to have her involved if there's a legal storyline on the show because otherwise she has no storyline. Even the scene where Laurel says he must hate her, (after previously saying she was just doing her job and being abrasive about getting his mother life instead of the death penalty) just annoyed me.
