Josh & Anna Smuggar: A Series of Unfortunate Events
anony mouse replied to maraleia's topic in Counting On
All state bars have a "character and fitness" test for applicants to determine whether they are able to sit the bar. You have to divulge things like past or present mental illness, whether you are taking any sort of prescription medications, why you flunked out of that one random class in college, etc. Pertinent to Josh, you have to divulge if you've been investigated and the outcome of that investigation - even if you were a juvenile and it's been sealed. When I sat the bar, I had to try and figure out when I received a traffic ticket some ten years prior and provide a copy, even though it was a fender bender. The process is rigorous and any misrepresentation, even if accidental, is a huge mark against you. In my state, they would let people with prior convictions, investigations, or mental illness/addiction sometimes sit the bar, but usually after a long period of time - to be considered fit, you had to demonstrate substantive change. Given the allegations against Josh, I have no idea how long a period that would be, but I don't think the "counseling" he had would meet the expectations of addressing the issue. The amount of hoops I had to jump through to show I had addressed a few difficulties I had early on in law school, despite later making the Dean's List, were insane. I can't imagine what they'd expect from Josh. -
I agree, after Andi's season, I liked Nick and thought he got a raw deal. Andi was the person who came off poorly to me. I'm not sure how I feel about Nick coming back. Perhaps he really did have a connection with Kaitlyn, but this also looks a ton like producer manipulation. I'm rooting for him, but cautiously.

Law school would be difficult - he would have to divulge details of his case both for admission to a law school as well as for permission to sit the bar exam. It's far enough in the past they might let him sit the exam, but that can be a crapshoot. That said, I think your idea is the best plan for him to get his life back on track. For Anna and the kids, I hope he is able to do something like that. -
See, that's what makes me think she might actually like him. Girl could do better, so maybe Brady is better in person?

Maybe things are done differently in Arkansas, but I find it odd that the caseworker called 911 over this. In my state, the caseworker would contact LE directly, unless there was some sort of Josh Powell emergency situation going down. Further, I'm not sure what LE could do for them without a warrant. Either Arkansas runs the show very differently, or something hinky is going on. -
I'd be happy to help but I make no promises about having the right info! If it's the thread I'm thinking of, it had to do with trusts/payment in one sum, which isn't my field. I handle criminal law, so I can speak to doing a bunch of records requests in another state, none of which were ever timely.

At the same time, records are always delayed. I've done quite a few records requests as an attorney and they never are processed in the amount of time they should be.

I'm not surprised - there are some crazy people out there. I'm sure the family has received threats. I'm glad TLC has someone there, as I do worry about the M kids and some loon. -

I remember, but I don't remember which kid it was - maybe Joseph or Jason? -
I've eaten tater tot casserole (not their recipe) and it's delicious. Usually it's either a creamier, cheesy version that is closer to the Duggar recipe, but sometimes I've had it prepared more like a shepherds pie. Either way, it's not gourmet but it's tasty.

I actually hope they do get exposed, that way the girls can get some control over this, even if via a lawsuit. We have no idea how they feel about this, but they have a right to privacy that has been blown to smithereens possibly in violation of the law. In my opinion, releasing this report is violating them all over again, and this person needs to be exposed so more information isn't leaked. The public doesn't need to know the dirty details. -
I was taught that Mary was born sinless because St. Anne and St. Joachim were older and desperately wanted a baby. They prayed to God, promising to pledge their child in service of the temple, if God would grant them a baby. Subsequently, Mary was born and for a time, served in the temple before her betrothal to Joseph.I don't believe this is required belief, but it is accepted doctrine regarding the explanation for God's intercession into Mary's lack of original sin.

I actually prefer the way People presented the headline, rather than focusing on the girls. So far, most of the attention has been on Josh. I'm worried when the media decides nothing new is forthcoming from that angle and turns on the girls.

Yes, his statement was ambiguous enough that it could be interpreted in a few ways. I feel for Jill. It's hard enough to deal with your first child without all this drama. I hope she's coping okay.

Or the Duggars turned the firm down and it saw an opportunity to get its name out there. Frankly, making a statement about a potential client seems highly unprofessional to me.
-
That is true. I've worked in criminal defense for four years, and many times, reports are inaccurate. Just because it is in the narrative doesn't mean that it's true. Usually, there is some grain of truth. Conversely, things may not be in the report that are far worse. So at this point, God only knows what happened.

Nathan Bedford Forrest may be a relative. Further, although he helped found the Klan, he dissolved his chapter in 1869, and eventually went on to advocate a progressive for the time agenda of racial equality by 1875. I don't think you can make any determination of their feelings solely by a picture on a wall.

If you look into the Pearl book's horrible "train up a child" methods, one discipline involves hitting your child with flexible PVC pipe with the idea of "spare the rod, spoil the child." It's horrific - it is advocated for even babies as part of blanket training. The Duggars follow these methods to some degree, although it's not been shown on tv, and the police report referenced a statement from one child about being hit with a rod. Frankly, I believe it's only the presence of the cameras which has kept the younger kids from most of this "training," and I'm fearful of what will happen when they are gone. -

She doesn't need to know their names to beat them with a rod, which is something they've done in the past, according to the police report. -

I feel the opposite. If the cameras go away, there's nothing stopping them from using the Pearl's heinous "training" on them all the time. The cameras are a layer of protection for some of these kids. -
I took Moxie CrimeFighter's comment as firmly tongue in cheek, for what it's worth. Looking at the wording of the post, I think it was meant humorously.

In my opinion, there is a vast difference between adult sex offenders and adolescent offenders. At 14, Josh was at an age where he may have been motivated by other factors than the usual adult sex offender, which would affect the likelihood of recidivism. He was young enough that his actions may have been born from his environment, rather than an innate urge we see with habitual adult offenders. None of this is meant to excuse his actions, as they were wrong regardless of his motivation, but I don't think we can automatically paint him with the same brush as adult offenders without more information. Unless more information comes out, he hasn't offended again, which could be a sign he was not motivated to offend in the traditional pattern of adult sex offenders, and thus may not reoffend. -
Conversely, the lack of locking doors and constant buddies, even in sleep, might have been a misguided attempt to protect the girls.

And boy does the whole molestation issue put a new spin on that. I now think we know why it was private, and that makes the rumors surrounding that choice even sadder.
