How long is Joe in school?  Most kids go to preschool in the morning only, so Jay could have been at the retirement party to give a speech and he could have easily made a cake decision over the phone (although it would have made more sense to make the decision the day before, if not earlier).  If Gloria was still at Jury Duty, Jake could bring Joe with him.  

 

This whole episode felt like it was written like they had certain jokes in mind and created situations to lead to those jokes, but they didn't bother to make sure that those situations were logical.  

I find lots of plots on this show are written like they have the punch line in their heads, and then write a situation to lead to it. It's way too try-hard.

They then fluff it with some flouncing by Cam, whining by Mitchell, screeching by Gloria, highstringiness by Claire, goofiness by Phil and a cantankerous entitlement comment by Jay. If there's time, they'll add a dimwit remark from Luke, bitchy smartassiness from Alex, weirdness from Manny, party girl comment from Haley, and wrap it up with a pithy witticism from Lily.

Actually that is the basic formula right there.
