This is why paternity had to be established before Christine’s child support/custody case could proceed. Being on the birth certificate or not, they were never legally married.

 

Actually paternity only has to be determined if the father refuses to acknowledge the child as his own. If there's no contesting it, the birth certificate can stand.

Not in Utah for a couple who were never legally married. That’s the catch, no legal marriage.

But again, if the father is not denying paternity there is no need for automatic testing. (Plus, no need for paying $$ for testing).

Could you please find and quote the law you are referring to? I find this so intriguing.

I don’t recall saying anything about testing. If Kody signed the Voluntary Declaration of Paternity, there would be no need to test and then the child support case would proceed. If he challenged it then testing would be ordered. I’d assume he acknowledged paternity. 🤷🏼‍♀️

When I wrote 'if the father does not deny paternity, the courts don't need (genetic) testing'*, you responded, 'Not in Utah. You have to be legally married, they're not married."*

So I took that to mean because they weren't married they have to get tested automatically, to go to court.

*I'm paraphrasing
