I believe the reason Merlin stood over the Dark One and missed his opportunity to tether the darkness to the broken shard of Excalibur from that individual is because the Dark One was actually his first love, overtaken by the darkness. Perhaps he was powerful enough to tether the darkness into the "dagger" without being bound to it himself but yet unable to bring himself to kill his first love in the process.
