My FIL is (was) a highly respected labor lawyer. A bit of his resume. Before 40 he was appointed lead counsel for the State of Florida for labor and employment. My husband has never forgiven him for moving them to Tallahassee from Cleveland.

Basically anybody they fired in the State had to go through him (later had own private practice - his main clients were basically every County Sheriff’s office in Florida except for one or two). He was also heavily involved in the American Bar Association - he was Section Chair for Labor and Employment Law (Public Sector Management) for years. That’s only why I really know anything about labor law. I’ve attended a lot of ABA events/other social things over the years and know his friends. They like to gossip. In his “spare” time he was a Professor at several different law schools in Florida.

Though my FIL is not the same man he used to be (age, stroke, other issues), I figure at least this might give him something to do. He desperately needs a hobby...and I’m dying of curiousity to get a professional opinion re the merits of her suit.

I linked the PDF version of the lawsuit a few pages back. I'll find it and post it.

If anyone is interested... YouTube a review on a Maserati. It’s basically a dressed up dodge. The best part is that almost every review says only a fucking idiot who wants to show off and knows absolutely nothing about cars would purchase that vehicle.

That’s exactly what Mr. DC says. He likes cars. 

His comment was directed years ago at the Guidice’s. According to him the Mercedes S-Class, Audi A8 and BMW 7-Series (not sure his order) are all far superior for a better price. 

He used to catch the occasional RHNJ episode with me. He literally laughed out loud when he saw it - “is that the Maserati sedan? - what idiots”. 

Not like he would turn it down if offered to him....

Several years ago, when I first saw the Maserati sedan, I thought if I were super rich and wanted to burn some money, that's what I would buy because I thought looking at it, no regular people would dream it cost as much as it did, so it would be my little secret:  "I'm driving a super expensive car and you have no idea."  But I don't particularly like the styling, and I have an intense dislike of the trident emblem it has, for some reason.  And of course I'm not super rich.

Vicki Gunvalson, on RH Orange County, drives (not necessarily owns) a Maserati sedan.  And the Guidices, and now Farrah.  That's a rogue's gallery I'm not eager to join.

Damn, Debra EMBA is so ridiculously money-oriented.  It's douchey to announce the price of your Mercedes-Benz, which she did on the show when it got hit in the parking lot.  But to post a video showing a cigar and it's band and proclaim that you paid twenty-three dollars for it? Classy.

She even got the name of the Amazing Premium Cigar wrong.  The label clearly says Rocky Patel, and she calls it a Ricky Patel.  She's quite the Cigar Aficionado!

Ok a couple of things.  What do you think of Maci making a big fuss about Farrah doing porn and now Maci is running around in the woods in her birthday suit?  Is Maci the pot calling the kettle Farrah black???  Not sure how I'm feeling about all of this.

Next isn't it strange a woman that owns three businesses and owned how own home and was on a reality show raking in the bucks is now living with her daughter in her fathers home in suburbia???

I donno but something is off with all of that.

Farrah's retail store seems to be in constant hiring mode.  Her job description contains the usual grammar and punctuation errors, but I thought this was odd:

"Due to company structure through ADP payroll the company structure has all employees as independent contractors on 1099."

Not to be too nit-picky, but why would they even need a payroll service if everyone is a contractor, and what does ADP have to do with the company structure?  Also, employers can't just call everyone a contractor.  They have to meet certain criteria to qualify as independent contractors, otherwise they are definitely employees.  Farrah will probably discover this when someone files for Workers Compensation or Unemployment Insurance benefits.

A payroll service would still be helpful for processing the 1099s, but you're right, she almost certainly can't consider her employees contractors. 

That sentence is just insane. It's not the usual kind of native-speaker mistakes, and it's not like ESL speakers' mistakes, either. It is evidence of a scrambled mind. I wonder if her parents were too proud to get her early intervention or too oblivious to realize how badly she needed it.

Also, 1099 employees don't get things like medical benefits or paid leave. We also have to get our own business license and pay all our own taxes (including Social Security, Medicare and state O&M taxes). The company you work for pays none of it. The 1099 contracts I have work in my situation (consulting), but hiring retail staff as 1099s is a pretty cheap and sleazy way of doing business. So basically, totally Farrah.

Ok..weird Farrah things I saw this weekend, had to share and knew you would understand.

First my sister sent aclip from Farrah's channel to me. In several statements Farrah has stated she now wants to focus on "scripted performances" now with her career. Well about a month ago she posted scenes from her role in some film called ADAM K.  Her performance is an insult to the talent and professionalism of the stars of any kindergarten play.  

Then my best friend showed me part of one of her webcasts.  I think it was part of her Halloween webcast where she uses one of her line of vibrators (outside only). Man she needed a script for this..So unnatural (ironic) trying to be sexy was hilarius, she could not even believably moan, and was trying to read questions from viewers on her phone at the same time. Hilarious to the point of almost being embarrassing . Has anyone else seen or is willing to admit they have seen these and share their thoughts.

Totally MTV & Viacom as well since the cast members are also independent contractors. I am sure that is where Farrah got the idea.

I was describing Farrah's job description post to Mr. Outlier, and finally realized I couldn't do it justice so I had him read it himself.  He has a habit of furrowing his brow when he reads, which I'm trying to break.  So I said, "Stop furrowing your brow" and he said, "How can you not?"

The 1099 thing is particularly galling.  Furnished by Farrah is seeking high level people, of course.  Who can also drive a truck.  But what are the odds she's going to get them, and not some fangirl who just wants to work for Celebrity Farrah and isn't going to know the difference between being an employee and being an independent contractor...until tax time comes?  Kind of like how it happened to the teen moms themselves.

One the one hand, I feel sorry for someone who gets caught up in that trap, but on the other hand, don't be a fangirl and even if you're not, look at that job description long and hard before deciding you want to hitch your wagon to a high-end business that presents itself like that.  So maybe I don't feel sorry for them after all.

But I have an idea for an interview question:  "Please explain what this means, and how you will fit into this business: 'Furnished by Farrah was opened November 20th 2016 creating an entrepreneurial culture in furniture.'"

There is no way retail employees at Farrah's store qualify as contractors. She's going to get hosed by the labor department at some point if she ever pisses someone off.

Okay, so I checked out her webcast (the CamSoda video, anyway) and I concur. There's nothing natural about her at all. I've watched quite a bit of porn, I feel that I have a pretty good "eye" for what's good and what isn't. Farrah's is just, er, boring. I am not gay, but I can totally appreciate the female figure from an aesthetic standpoint. While her stomach and legs are nice and shapely, the plasticness (made up word there) of her boobs and butt is just really distracting. And the moaning...yikes! I mean, you should make SOME attempt at selling your crap. 

You know what distracted me the most though? There was an ad flashing in the lower right-hand corner that read: "Want to f**ck AN redhead?" In giant letters. I seriously couldn't get past that. Really people. Proofread your porn ads!

The "scripted film"

ADAM  K.  That she stars in is now listed on IMDB stating it is about I mild mannered man who want friends, put is left with dead bodies when he is rejected. He scenes are awful

  Film was supposed to released in Aug. Of 2017.

Wonder if it will make it to netflix ?

She better put on her silly glasses and hang on to that Froyo for dear life.

OK - I got a little feedback from my FIL re Farrah’s lawsuit via Mr. DC. I’ll try and be brief - have a ton of notes though.

Remember despite his resume he’s old, getting feeble minded and hasn’t practiced in years. And knows nothing about the background of her case. I also know very little about labor law so excuse mistakes in translation. Mr. DC did not have a good time in Vegas. His exact words were “slower than death”.

Basically he says her entire filing is something you can download verbatim from the Internet for about $500. If she’s an independent contractor the entire thing is moot cause she’s suing in several Counts under Title VII of the Civil Rights Act of 1964, which is then improperly applied. She needed to sue under different statutes(?). Maybe that’s why she claims it’s a “world changing” case.

Gender stereotypes is an actual thing! Not Farrah speak! Case was upheld by Supreme Court in 1989 for a case called Price Waterhouse vs Hopkins (Wikipedia explained it better to me than FIL - he used a lot of case history, lawyer speak I didn’t quite understand - see also maybe feeble minded). I don’t think it applies to her. If Viacom has a male “star” or even a known employee doing porn (see masturbating on a highly promoted webcam show) legal or not and they didn’t fire him she’s got a case. If not - it’s a real stretch. I certainly would be fired if my employer ever saw me doing something like that (legal or not).

I read the entire case too. It’s a real hoot. My favorite was Count V. Negligent Hiring, Retention and Supervision. I guess that’s Kristen the producer and the alleged candy pusher set-teacher.

If I was her I’d be careful about accusing others re Hostile Work Environment and Intentional Infliction of Emotional Distress. Oh and Wrongful Termination of course - so WTF does Michael keep insisting (via Twitter of course) she wasn’t fired? See again - it must be acid.

Are there any other lawyers on the Board who can chime in?

Yeah, there's no way that having contractors as your retail store help complies with labor law. She sets their hours and then they bill her? I guess that's a way to avoid payroll for a couple of days, and reduce the taxes you pay on employees, but it sounds like this business is circling the drain.

She might consider making most of their salary commission, but that doesn't circumvent the taxes part.

This case is really interesting!  (I am a corporate attorney, no labor law experience.)  I skimmed what I could find of the actual decision in that case, and like you I had previously assumed that this gender stereotyping thing was related to her webcam stuff.  But, I think it's better suited to address MTV's position that she was difficult to work with.  From the decision...

Thanks - it wouldn't work (wasn't highlighted that the text was strikethrough to begin with) but I just copied them out to another doc and cleaned and reinserted.  OCD corporate lawyer could not let that stand lol.

My laymen understanding is that Hopkins won because despite how “abrasive” she was (I probably would have hated her) especially in 1989, men far less capable acted as or worse on a regular basis and got promoted to Partner. Not sure how Farrah’s going to prove that. 

“Wear more make-up, walk, talk and act more feminine” was a well deserved nail in their coffin. Go Ann Hopkins! (As a non make-up wearing/non-manicured female in a male dominated industry).

I don’t have access to LexisNexis - but find the case fascinating too now that I know about it.

Well that's a reaction I don't get very often!  

It's sad but as I was reading the case I was thinking, dang as bad as women still have it, it's only been 30 years since that case where men felt like it was perfectly ok to make these recommendations about her - so in some ways we have already come a long way.  Men who, I am sure, were not all exactly easy to deal with themselves.  My first job at a law firm wasn't too much better 20 years ago - one male partner didn't like female associates to wear pants (creep liked to look at legs) and another "joked" during my review for the year that I got married that it was ok that I took a honeymoon as long as I didn't do it again.

Anyone see the picture of Farrah and Sophia at the march in Austin? Not wanting to get into a political discussion or anything but, considering past tweets and such, this appears to counteract her previous political "stands." I'm calling BS. She was just there for the photo ops.

I really miss Farrah’s brunette hair color. She always looked kinda exotic with her Syrian and Sicilian heritage. Even when she started ruining her face with plastic surgery the darker hair color worked best. 

Even though she’s a horrible person, I really do sense a sadness with her and I do think she either feels it right now or will soon, that those plastic surgeries were a mistake. She doesn’t look pretty anymore - she looks like a dumb plastic weirdo.

There is something about her appearance and mannerisms that come off creepy and awkward to me. She wasn’t always like that, either. I don’t think she’s as happy as she wants us to believe. Homegirl needs a real friend and not ass kissers because her money is being siphoned by her mother who’s how addicted to plastic surgery or Botox and a father that appears to have ditched any former job to cater to her and when those checks stop he will go with it. 

Whether she wants to admit it or not, MTV was her solid income - guaranteed income, and not the webcams she’s going now. She’s trying so hard to make people think she’s rich and that’s going to make her poor FAST. Nobody around her cares enough for her to help her. That’s all I have to say for now. I’m not a Farrah defender but I did like her in her 16&p episode and the first two seasons of TM - then she CHANGED big time!!!

@mandragor - did they hand out those sign at the Austin march?  Just curious since the ones Farrah and Sophia have have the same no gun logo as that one the guy next to them is holding.
